Peyton Estates Unit Five Water, Wastewater & Drainage and Regional Water & Wastewater Improvements

 

Sealed Bids, in envelopes addressed to Hunt Communities GP, LLC (‘Owner’), c/o TRE & Associates, LLC, 110 Mesa Park Drive, Suite 200, El Paso, Texas 79912, will be received at the above mentioned address until 10:30 a.m. on January 29, 2019, and then publicly opened and read, for furnishing all labor, material and equipment and performing all work required for the construction of Peyton Estates Unit Five Water, Wastewater & Drainage and Regional Water & Wastewater Improvements.

 

Prospective bidders are required to be pre-qualified. Qualification forms are included in the specification documents and must be returned to the Engineer, by the day of the pre-bid conference to be held at the office of the Engineer at 10:30 a.m. on January 22, 2019. Attendance at the pre-bid conference is mandatory and bids will be accepted only from pre-qualified bidders who attend the pre-bid conference. Any other proposals received by the Owner will not be considered.

Plans, specifications, and bidding documents may be secured from the office of the Engineer, TRE & Associates, LLC, for one-hundred twenty-five dollars ($125.00) per set, which is non-refundable.

 

Plans and specifications may be examined at the Engineer’s office at 110 Mesa Park Drive, Suite 200, El Paso, Texas 79912. The Secretary of Housing and Urban Development will bed $171,557.02.

 There will be no proration of Texas, rents or other income or liabilities, except that the purchaser will pay, at or before closing, his prorate share of any real estate taxes that have been paid by the Secretary to the date of the foreclosure sale.

 When making their bids, all bidders except the Secretary must submit a deposit totaling $17,155.70 in the form of a certified check or cashier’s check made out to the Secretary of HUD.  A deposit need not accompany each oral bid.  If the successful bid is oral, a deposit of $17,155.70 must be presented before the bidding is closed.  The deposit is nonrefundable.  The remainder of the purchase price must be delivered within 30 days of the sale or at such other time as the Secretary may determine for good cause shown, time being of the essence.  This amount, like the bid deposits, must be delivered in the form of a certified or cashier’s check.  If the Secretary is the highest bidder, he need not pay the bid amount in cash. any costs incurred as a result of such failure.  The Commissioner may, at the direction of the HUD representative, offer the property to the second highest bidder for an amount equal to the highest price offered by that bidder. 

 

There is no right of redemption, or right of possession based upon a right of redemption, in the mortgagor or others subsequent to a foreclosure completed pursuant to the Act.  Therefore, the Foreclosure Commissioner will issue a Deed to the purchaser(s) upon receipt of the entire purchase price in accordance with the terms of the sale as provided herein.  HUD does not guarantee that the property will be vacant.

 The scheduled foreclosure sale shall be cancelled or adjourned if it is established, by documented written application of the mortgagor to the Foreclosure Commissioner not less that 3 days before the date of sale, or otherwise, that the default or defaults upon which the foreclosure is based did not exist at the time of service of this notice of default and foreclosure sale, or all amounts due under the mortgage agreement are  tendered to the Foreclosure Commissioner, in the form of a certified or cashier’s check payable to the Secretary of HUD, before public auction of the property is completed.

 The amount that must be paid if the mortgage is to be paid in full prior the scheduled sale is $171,557.02, plus all other amounts that would be due under the mortgage agreement if payments under the mortgage had not been accelerated, advertising costs and postage expenses incurred in giving notice, mileage by the most reasonable road distance for posting notices and for the Foreclosure Commissioner’s attendance at the sale, reasonable and customary costs incurred for title and lien record searches, the necessary out-of-pocket costs incurred by the Foreclosure Commissioner for recording documents, a commission for the Foreclosure Commissioner, and all other costs incurred in connection with the foreclosure prior to reinstatement.

PUBLIC NOTICE FOR VARIANCE

 

Canutillo Heights Estates, L.P., is requesting the following variances from the County of EI Paso Subdivision Regulations for the proposed Canutillo Heights Subdivision Unit III, IV, V and VI:

 

Variance from a 60-foot wide street right-of-way to a 54-foot wide street right-of-way, with a minimum of 34 feet pavement, face of curb to face of curb.

 

Variance for the minimum lot size reduction from County’s allowable 6,000 sq. ft. to 5,500 sq. ft. for 85% of the proposed lots.

 

The proposed subdivision is located in Precinct Number 4 and is more specifically identified as Parcel 1: Lots 1 through 3, Block 6; Lots 1 through 6, Block 7; Lots 1 through 6, Block 8; Lots 6, 7, 8 and 9, and portions of Lots 4 and 5, Block 9; Lots 1 through 9, Block 10; Lots 1 through 4, Block 11; and Lots 3, 4 and 5, and a portion of Lot 2, Block 12, CANUTILLO INDUSTRIAL PARK, an addition to El Paso County, TX.  TEXAS COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM

 

El Paso County will hold a public hearing at 6:00 p.m. on January 30th, 2019, at the ESD#2 Fire station, located on 13978 Montana, El Paso, TX in regard to the submission of grant application to the Texas Department of Agriculture for a 2019-2020 Community Development Fund. The purpose of this meeting is to allow residents an opportunity to discuss community resident’s participation plan, the development of local housing and community development needs, the amount of TxCDBG funding available, all eligible TxCDBG activities, and the use of past TxCDBG funds.  The County encourages residents to participate in the development of this TXCDBG application and to make their views known at this public hearing.  Citizens unable to attend this meeting may submit their views and proposals to the County of El Paso at 800 E. Overland St., Ste. 200, El Paso, Texas 79901. Persons with disabilities that wish to attend this meeting should contact the Munzer Alsarraj at (915) 543-3845 to arrange for assistance. Notice is hereby given that the El Paso County Election Department will conduct its Test of Automatic Tabulating Equipment on Saturday, January 26, 2018 at 10:00 a.m. for the January 2019 Special Election. Bids and construction projects in excess of $100,000, the bidder shall furnish a certified cashier’s check made payable to the order of County of El Paso or a good and sufficient Bid Bond in the amount of 5% of the total contract price, executed with a surety company authorized to do business in the State of Texas.  The bid bond must be included with the bid at the time of the opening.  Successful bidder must comply with all bonding requirements as stated in the Texas Local Government Code §262.032.
